Welcome to Jones Wholesale, Inc./Old Dominion Slush Puppie (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website and services, including the purchase of food, beverage, and related distribution products (“Products”). By placing an order or using our website, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please discontinue use of our website and services.

 

1. Business Overview

We are a food and beverage distributor located in Virginia (VA).

We sell frozen and pre-packaged food, beverages, and related distribution products/equipment primarily to businesses and authorized customers.
 

2. Use of the Website and Services

By using our website, you agree to:

  • Provide accurate and complete contact and order information

  • Use our services only for lawful business purposes

  • Not disrupt or attempt to interfere with our website functionality

We may refuse service, cancel orders, or terminate access for violations of these Terms.

 

3. Account Information (If Applicable)
If you create an account:

  • You must keep your login information secure

  • You are responsible for all activity under your account

  • You agree to notify us immediately of any unauthorized access

We may suspend or close accounts at our discretion.

 

4. Product Availability & Descriptions

We do our best to provide accurate information, but:

  • Product availability may change without notice

  • Prices are subject to update

  • Product descriptions, images, and details may contain typographical errors

 

We reserve the right to correct inaccuracies or cancel orders based on incorrect listings.

 

5. Orders & Payments

By placing an order, you agree that:

  • All orders are subject to acceptance and availability

  • Payment information you submit must be valid and authorized

  • We may limit or refuse any order

If an order is canceled, we will notify you and issue any applicable refunds.

 

6. Delivery & Risk of Loss

  • Delivery timelines are estimates and may vary based on location and logistics

  • Title and risk of loss transfer to the customer upon delivery to the carrier or your location

  • Any delivery issues must be reported promptly

Additional delivery terms may apply for bulk, palletized, refrigerated, or specialized transport.

7. Equipment Rental With Minimum Purchase

We may offer certain equipment (such as machines, coolers, display equipment, etc.) at no additional cost when customers meet minimum product purchase requirements.

By accepting rental equipment, you agree that:

  • The equipment remains the property of Jones Wholesale, Inc./Old Dominion Slush Puppie unless stated otherwise

  • You must clean the machine and/or cooler on a regular basis.

  • Equipment may only be used to promote and store products purchased from Jones Wholesale, Inc.

  • We may impose additional charges or retrieve the equipment if minimum purchase commitments are not met.

  • A formal Rental Agreement must be signed upon or before the first delivery.

Minimum purchase requirements:

  • Slush Puppie

    • For Bunn or CAB machines

      • 4 cases of Flavored Base as listed under “Rent” option on product page.

      • 1 case of Slush Puppie cups (any size)

    • For Stoelting 100 Floor or Counter models:

      • 3 cases of Neutral Base as listed under the “Rent” option on product page.

      • 6 bottles of flavor squirt.

      • 1 case of Slush Puppie cups (any size)

    • For all Machine models after initial purchase to keep the rental active:

    • Ongoing product purchases throughout the year, either via website or contact with sales team, combined with initial purchase are equal to or greater than 16 cases of Flavored Base or 12 cases of Neutral Base during a 12 month period.

    • If the rentee has not purchased the minimum number of cases after 12 months, we reserve the right to charge the rentee a $50 purchase fee per case for each case short of the minimum.

  • Mini Melts Ice Cream

    • We offer a freezer for storing/serving the Mini Melts product at no additional cost to the customer, provided they fulfill the following terms:

      • The freezer will be used for Mini Melts product only.

      • Purchase Mini Melts exclusively from Jones Wholesale/Old Dominion Slush Puppie.

      • Completely fill the freezer on the first order. (Applies to Grab-n-Go)

      • If ordering Bulk, customer must purchase a minimum of 4 cases of product on the first order.

      • Purchase a minimum amount of product on an on-going basis throughout a rolling 12-month period, as specified in the Rental Agreement.

 

8. Customer Data & Privacy

We only collect personal or business information that customers voluntarily provide when:

  • Placing orders

  • Creating accounts

  • Contacting us directly

We do not sell customer information.

We only use customer-provided data to process orders, manage accounts, and communicate regarding business transactions.
 

9. Intellectual Property

All website content—including text, images, branding, graphics, and design—is owned by or licensed to us. You may not:

  • Copy, reproduce, distribute, or modify our content

  • Use our trademarks without written permission

 

10. Third-Party Links

Our website may include links to third-party websites. We are not responsible for:

  • Content on third-party sites

  • Any damages resulting from accessing them

Accessing third-party sites is at your own risk.

 

11. Disclaimer of Warranties

Our products and services are provided “as is” and “as available,” except where otherwise required by food safety or product quality laws.

We do not guarantee:

  • Uninterrupted access to our website

  • Error-free content

  • That products will meet any specific use other than their intended purpose

 

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • Indirect, incidental, or consequential damages

  • Loss of business, revenue, or data

  • Procurement of substitute goods

  • Issues arising from misuse or improper storage of products

Our total liability will not exceed the amount paid for the specific order giving rise to the claim.

 

13. Indemnification

You agree to indemnify and hold us harmless against all claims, damages, and expenses arising from:

  • Your misuse of our products or equipment

  • Violations of these Terms

  • Improper handling, storage, or resale of products

 

14. Compliance With Food Safety Laws

By purchasing our products, you acknowledge:

  • You are responsible for proper handling, storage, and use of all food and beverage items

  • You will comply with applicable health, safety, and food handling regulations

  • We are not responsible for product issues arising from improper storage after delivery

 

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Any disputes will be handled exclusively in Virginia state or federal courts.

 

16. Changes to These Terms

We may update these Terms at any time.

The “Last Updated” date indicates the latest version.

Continued use of our website or services after changes means you accept the updated Terms.
